Welcome to Bikiwi Bikinis (“Bikiwi”, “we”, “us”, “our”) 🥝👙

We create colorful, Latin-inspired swimwear and a tiny universe of joy, magic and self-love. These Terms of Service (the “Terms”) explain how you can use our website, store and all related content, features, tools, products and services (collectively, the “Services”).

Bikiwi Bikinis is powered by Shopify, which enables us to provide the Services to you.

Please read these Terms carefully – they include important information about your legal rights and obligations, including warranty disclaimers and limitations of liability. Nothing in these Terms affects any mandatory consumer rights you have under applicable law (for example, in Spain or the European Union).

We do our best to show our bikinis and products as realistically as possible. Still, please remember:

Colors and appearance may vary slightly depending on your screen, device and settings.
We do not guarantee that every item will look exactly as it appears on your screen or will meet every expectation – but we really hope you love it 💖

We may change product descriptions, prices, or availability at any time, without notice. We also reserve the right to:

discontinue any product at any time, and
limit quantities for any person, region or jurisdiction, on a case-by-case basis.

SECTION 3 – ORDERS 🧾

When you place an order, you are making an offer to purchase products from Bikiwi Bikinis.

We reserve the right, at our discretion, to accept or decline an order for any reason (for example, stock issues, suspected fraud, incorrect pricing). Your order is considered accepted only when we confirm it (for example, via order confirmation email). We must receive and successfully process your payment before acceptance.

Please check your order carefully before submitting. Once an order is accepted, we may not be able to update or cancel it.

If we do not accept, need to change, or have to cancel your order, we will attempt to contact you via the email, billing address and/or phone number you provided.

You represent that your purchases are for personal or household use only, and not for resale or export on a commercial basis.

SECTION 4 – PRICES AND BILLING 💳

All prices, discounts and promotions are subject to change without notice.

The price charged will be the price in effect at the time you place your order, as shown in your order confirmation.
Unless we clearly state otherwise, prices do not include taxes, customs or import duties, shipping or handling charges.

Prices in our online store may differ from prices in any future physical locations or from offers from third parties.

Sometimes we run promotions or special offers that have their own terms. If those terms conflict with these Terms, the promotion terms will apply for that specific offer.

You agree to provide current, complete and accurate purchase and payment information and to promptly update details such as email address or card expiry dates so we can process your orders and contact you when needed.

By providing payment details, you represent that:

the information is true, correct and complete;
you are duly authorized to use that payment method;
charges incurred by you will be honored by your payment provider; and
you will pay all charges at the posted prices, including shipping, handling and any applicable taxes.

SECTION 5 – SHIPPING AND DELIVERY 🚚

We will do our best to ship your Bikiwi treasures quickly, but:

all delivery times shown are estimates only, not guarantees;
we are not responsible for delays caused by carriers, customs, weather or events outside our reasonable control.

Once products are handed over to the carrier, title and risk of loss pass to you. Please check your shipping address carefully when ordering.

SECTION 6 – INTELLECTUAL PROPERTY 🎨

Everything you see and experience in our Services – including our brand name, logos, designs, photos, videos, graphics, text, layout and other content – is owned by Bikiwi Bikinis, our partners or our licensors and is protected by applicable intellectual property laws (including copyright and trademark laws) in Spain, the EU and other jurisdictions.

We grant you a personal, non-exclusive, non-transferable right to use the Services for your own, non-commercial use, in accordance with these Terms.

You must not, without our prior written consent:

All rights not expressly granted in these Terms are reserved by Bikiwi Bikinis (and by Shopify and other third parties for their respective rights).

New features or services we add in the future will also be considered part of the “Services” and will be subject to these Terms.

Bikiwi Bikinis is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Bikiwi Bikinis.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Bikiwi Bikinis, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Bikiwi Bikinis.

By submitting Feedback (for example via email, reviews, social media tags or forms), you grant us a worldwide, perpetual, royalty-free, sublicensable license to use, reproduce, modify, publish, distribute and display that Feedback in any medium, for any lawful purpose (including to improve and promote Bikiwi and the Services), without obligation to compensate you.

You promise that:

you own or control all rights in your Feedback;
your Feedback does not infringe any third-party rights (privacy, copyright, trademark, etc.); and
your Feedback is honest and complies with these Terms.

We may, but are not obliged to, monitor or remove Feedback that we consider unlawful, offensive, misleading or otherwise inappropriate.

You are solely responsible for any Feedback you provide and its accuracy.

your violation of any law or third-party rights; or

We will notify you of any such claim where reasonably possible, and we may assume the defense at our own cost. You agree to cooperate with us in such defense.

These Terms, together with any policies or notices posted on our site (including our Privacy Policy and Refund Policy), constitute the entire agreement between you and Bikiwi Bikinis regarding the Services, and replace any prior agreements or communications.

Any ambiguities in these Terms shall not be interpreted against the drafting party.

You may not assign, transfer or delegate your rights or obligations under these Terms without our prior written consent. Any attempt to do so will be null and void.

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Spain, without regard to conflict of law principles, and subject to any mandatory protections you have as a consumer in your country of residence (for example, within the EU/EEA).

You and Bikiwi Bikinis agree to submit to the non-exclusive jurisdiction of the courts of Barcelona (Spain), which means you may also be able to bring a claim in the courts of your country of residence where required by consumer law.
